Welcome to Consignment POS. These Terms of Service (“Terms”) govern your access to and use of the consignmentpos.com website and our suite of cloud-based software, including the consignment POS system, consignment store point of sale, resale shop POS systems, consignor management software, thrift store POS, and inventory tracking tools (collectively, the “Services”). By accessing or using our Services, you agree to be bound by these Terms. If you do not agree, please do not use our Services.

1. Acceptance of Terms

By registering for, accessing, or using any part of the Consignment POS Services, you acknowledge that you have read, understood, and agree to be bound by these Terms, our Privacy Policy, and all applicable laws and regulations. If you are using our Services on behalf of a business or other entity, you represent that you have the authority to bind that entity to these Terms.

You must be at least 18 years old, or the age of majority in your jurisdiction, to use our Services. If you do not meet these requirements, you may not use Consignment POS. These Terms apply to all users, including store owners, staff, consignors, and customers interacting with the system.

2. Service Description

Consignment POS provides an all-in-one software solution for consignment stores, resale shops, thrift stores, and other businesses managing secondhand inventory. Our services include cloud-based consignment POS, inventory tracking for consignment, consignor management software, and specialized point-of-sale tools for retail environments.

The core features of our Services are designed to help businesses process sales, track inventory, manage consignors, generate reports, and streamline day-to-day operations. We may add or update features to enhance functionality and improve user experience at any time, with or without notice.

3. User Accounts and Registration

To use many features of Consignment POS, you must register and create a user account. During registration, you agree to provide accurate and complete information and to keep your account information up to date. You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

If you suspect unauthorized access to your account, you must notify us immediately. We reserve the right to suspend or terminate accounts that we believe are being used in violation of these Terms or our policies, or to protect the security and integrity of our Services.

4. Use of Services

You may use Consignment POS solely for lawful purposes and in accordance with these Terms. Our Services are intended for use by consignment businesses, resale shops, thrift stores, and similar operations for legitimate business activities, such as sales processing, inventory tracking, and consignor management.

You agree not to misuse our Services, including but not limited to:

  • Attempting to gain unauthorized access to systems, networks, or user data;

  • Engaging in fraudulent, abusive, or illegal activities;

  • Uploading or distributing viruses or malicious code;

  • Copying, reverse engineering, or reselling our software without permission.

We reserve the right to investigate violations and take appropriate action, including termination of access.

5. Updates, Maintenance, and Service Interruptions

We strive to maintain high availability for our Services, but we cannot guarantee uninterrupted access at all times. Periodic updates, maintenance, or unforeseen technical issues may result in temporary downtime or service disruptions.

We will make reasonable efforts to provide advance notice of scheduled maintenance and to restore services as quickly as possible in the event of interruptions. Consignment POS is not liable for any losses or damages resulting from service downtime or unavailability.

6. Termination and Account Cancellation

You may terminate your account at any time by contacting our support team or using the cancellation options within your account dashboard. Upon termination, your access to Consignment POS and all associated data will be deactivated. We recommend exporting any important data before terminating your account.

We reserve the right to suspend or terminate accounts for violation of these Terms, non-payment, or abuse of our Services. We may also terminate or modify our Services at any time, with or without cause and with or without notice.

7. Limitation of Liability

To the maximum extent permitted by law, Consignment POS and its affiliates, officers, employees, or agents shall not be liable for any indirect, incidental, consequential, special, or punitive damages—including, but not limited to, loss of profits, business interruption, or data loss—arising from your use of or inability to use our Services.

Our total liability for any claim related to these Terms or the use of our Services will not exceed the amount paid by you to Consignment POS in the twelve (12) months preceding the claim.

8. Changes to Terms of Service

We reserve the right to update or modify these Terms at any time. Changes will be effective upon posting to our website, with the “Last Updated” date revised accordingly. Your continued use of Consignment POS after changes are posted constitutes your acceptance of the revised Terms. We recommend reviewing these Terms periodically to stay informed.
